Mckinley Sourcing Pty Ltd (ABN 75 673 878 085) understand the importance placed on the privacy and personal information.

It will take reasonable steps to protect the privacy of the personal information that it collects and use. This relates to all corporate clients, individuals, job applicants and prospective employees.

Personal information

Personal information is any material that can be used to identify any individual. Sensitive information is a special category of personal information and includes information about health, race, ethnic origin, politics, religious beliefs, membership of a trade union, sexual preferences and criminal record. Personal Information will not be disclosed without consent in accordance to the Privacy Act 1988 (Cth).

Collection of Personal Information

Mckinley Sourcing collect the personal information of job applicants to facilitate placement, recruitment opportunities, and to deliver the best possible service. It also collect and use personal information for the following purposes:

  • provide further information about the recruitment opportunities or services;

  • facilitate application for employment to prospective employers;

  • placement operations and recruitment purposes; and

  • inform job applicants other opportunities that may be of interest.

Personal information which are collected may include names, date of birth, current address, email address, telephone numbers, work history, performance appraisals, qualifications, health information, personal history, opinions from referees, and our assessment of prospective candidate for recruitment.

The details of collected personal information are categorised into the following:

  • personal information obtained from applicants in connection with previous periods of employment;

  • work performance information and qualifications;

  • information about incidents in the workplace;

  • information and opinions from referees;

  • information submitted and independently obtained in relation to absences from work due to leave, illness or other causes; and

  • information obtained to assist in managing client and business relationships.

Mckinley Sourcing will not use personal information for any purpose which is not related to the recruitment services that it provides. It will take reasonable steps to ensure the personal information that it hold is accurate. If the job candidates perceive that the information about themselves is not accurate, please contact Mckinley Sourcing to update relevant details. If a job applicant decides not to provide any personal information, Mckinley Sourcing may not be able to offer the applicant the required service or assistance needed which includes the coordination of appropriate job interviews.

Mckinley Sourcing collect personal information directly from clients, individuals, job applicants and prospective employees. Mckinley Sourcing will obtain personal information from third parties such as referees, educational institutions and former employers. It will also collect personal information about job applicants and clients from public sources such as newspapers, journals, directories, the Internet and social media. Personal information from publicly available sources will be managed in accordance with Australian Privacy Principles and its Privacy Policy.

Disclosure of Personal Information

Mckinely Sourcing may disclose personal information to:

  • prospective employers;

  • external organisations seeking labour;

  • referees;

  • former employers;

  • educational institutions;

  • corporate clients;

  • professional advisors including accountants, auditors and lawyers; and

  • related companies, contractors and suppliers.

Sending Personal Information Overseas

Mckinely Sourcing will send Personal Information overseas when required. It will take measures to protect Personal Information. It will protect Personal Information by ensuring that the country of destination has similar protections in relation to privacy or that the recipient of personal information will safeguard privacy.

Access Personal Information

Clients, individuals, job applicants and prospective employees have a right to access their Personal Information which is subject to certain exceptions provided for in the Privacy Act 1988 (Cth). If access to personal information is required, the request must be writing and proof of identity is required. If Personal Information is not accurate, incomplete, or outdated, Mckinley Sourcing will take easonable steps to correct its records and that of any third parties.

Security of Personal Information

Mckinely Sourcing will take reasonable steps to secure Personal Information. Electronic information is protected by security measures. Access to information as well as databases are restricted to the staff at Mckinley Sourcing and its third party providers who need access to information in order to perform their duties.

Complaints

All complaints will be treated seriously and addressed appropriately.

Fair Trading Amendment (Employment Placement Services) Act 2002 and Regulations requires Mckinely Sourcing to state the following:

  • Mckinley Sourcing Pty Ltd is an employment placement service and do not charge candidates (job applicants) services fee for the purpose of finding that employment; and

  • It does not engage in any misleading or deceptive conduct including activities such as:

    • advertising a position as being available when we know no such position exists; and

    • knowingly giving misleading information to a candidate about the nature of a position.

Job applicants who believe that any employment placement service has acted inappropriately may contact the New South Wales Fair Trading.

Access to Personal Information

Mckinley Sourcing will provide access to the client or job applicant’s personal information. It will provide, maintain and give effect to their right to privacy.

At all times, its conduct will be governed by the following:

all requests will be dealt with promptly confidential manner;

  • any inaccurate or outdated information will be corrected; and

  • requests to access personal information will not affect any commercial or professional arrangements between the client, job applicant and Mckinley Sourcing.

For security reasons, requests need to be in writing with the provision of proof of identity. This is necessary to ensure that Personal Information is provided only to the correct individuals and that the privacy of others are safe guarded. If a client or job seeker are able to establish that the personal information that Mckinley Souring possess is not accurate or complete, it will take reasonable steps to correct its records.

Denied Access

Access to Personal Information will be denied by Mckinely Sourcing if:

  • the request does not relate to the personal information of the person making the request;

  • providing access would pose a serious and imminent threat to the life or health of a person;

  • providing access would create an unreasonable impact on the privacy of others;

  • the request is trivial;

  • the request relates to existing or anticipated legal proceedings;

  • providing access would prejudice negotiations with the individual making the request;

  • access would be unlawful;

  • denial of access is authorised or required by law;

  • access would prejudice law enforcement activities;

  • access discloses a 'commercially sensitive' decision making process or information;

  • any other reason that is provided for in the National Privacy Principles.

Mckinley Sourcing will take all reasonable steps to provide access of the information requested within 20 business days from the time of request. In situations where the request is complicated or requires access to a large volume of information, it will provide access to the information requested within 40 business days. It may seek payment for our costs of supplying the requested information.
